Terms of Use

These Terms of Use ("Terms") govern your access to and use of Nexa VoIP's services, including but not limited to Voice over Internet Protocol (VoIP), SIP Trunking, Direct Inward Dialing (DID), and Toll-Free Number (TFN) services ("Services"). By using our Services, you agree to be bound by these Terms and our Privacy Policy.

If you do not agree with these Terms, you may not use our Services.

1. Eligibility and Account Registration

To use our Services, you must be at least 18 years old and legally capable of entering into a binding agreement. You agree to provide accurate and complete information during the registration process and to update it as necessary.

2. Services Provided

Nexa VoIP offers the following telecommunications services:

  • VoIP calling and termination
  • SIP trunking solutions
  • Direct Inward Dialing (DID) numbers
  • Toll-Free Number (TFN) provisioning
  • Optional add-ons such as voicemail, SMS, call forwarding, and analytics

Nexa VoIP does not guarantee uninterrupted or error-free service. Services are provided on an "as-is" and "as-available" basis.

3. Acceptable Use Policy

You agree not to use our Services:

  • For any unlawful, abusive, harassing, libelous, fraudulent, or malicious activity
  • To send unsolicited communications ("spam") or automated robocalls
  • To infringe on the intellectual property or privacy rights of others
  • In a manner that interferes with the operation or integrity of our network
  • For calling card, wholesale traffic aggregation, or PBX resale without express written consent

Nexa VoIP reserves the right to suspend or terminate Services without notice for violations of this policy.

4. Billing and Payments

  • Services are billed in accordance with your selected plan or agreement.
  • Charges may include usage fees, setup fees, monthly recurring charges (MRC), and applicable taxes.
  • All invoices are due on the due date specified. Late payments may incur fees and service suspension.
  • Prices are subject to change with notice. Continued use of the Services constitutes acceptance of the new pricing.

5. Number Porting and Ownership

  • You may port numbers into or out of Nexa VoIP, subject to verification and regulatory requirements.
  • You acknowledge that TFNs and DIDs are subject to availability and regulatory restrictions.
  • Number ownership resides with the customer as long as all account obligations are met.

6. Service Availability and Maintenance

Nexa VoIP aims to provide 99.99% uptime. However, scheduled maintenance, emergency repairs, and third-party failures may result in temporary outages. We are not liable for any damages caused by service interruptions.

7. Privacy and Data Handling

Your use of our Services is subject to our Privacy Policy. We may collect and store data related to call records, usage, and account information in accordance with applicable laws.

8. Limitation of Liability

To the fullest extent permitted by law, Nexa VoIP and its affiliates shall not be liable for:

  • Indirect, incidental, or consequential damages
  • Loss of data or profits
  • Unauthorized access to transmissions or data
  • Delays or failures in performance beyond our reasonable control

Our total liability shall not exceed the amount paid by you for the Services in the preceding three (3) months.

9. Indemnification

You agree to indemnify and hold harmless Nexa VoIP, its officers, employees, and affiliates from any claims, liabilities, damages, and expenses (including attorney’s fees) arising from your use of the Services, your violation of these Terms, or your infringement of any third-party rights.

10. Modifications to the Terms

We reserve the right to update or modify these Terms at any time. Changes will be posted on our website and will become effective upon posting. Continued use of the Services after changes constitutes acceptance.

11. Termination

You may cancel your Services at any time, subject to any applicable contractual terms. Nexa VoIP may suspend or terminate your account for violations of these Terms or non-payment.

12. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of [Your State/Country]. Any disputes shall be subject to the exclusive jurisdiction of the courts located in [Your Jurisdiction].
